Judge may not accept plea deal in fatal shooting near Soldiers Meadow

A plea deal reached between prosecutors and defense attorneys regarding the fatal shooting of a wanted man in the Soldiers Meadow area last year could be rejected.

2nd District Judge Jeff Brudie met with both parties to discuss the case against 57-year-old Daren McCann, who shot and killed 49-year-old fugitive Jerry Glass after he caught Glass burglarizing his Soldiers Meadow cabin. McCann, who was initially charged with second-degree murder, pleaded guilty to a reduced charge of voluntary manslaughter in May after mediation led to a binding plea agreement.

Under the terms of the agreement, McCann would receive an underlying sentence of three to seven years, which would be suspended in lieu of seven years probation. McCann could serve as long as one year of local jail time, and the defense would be free to argue for less at sentencing.

Judge Jeff Brudie called a hearing Friday to hear arguments from both the prosecution and the defense about why he should accept the deal.

Following the hearing the judge said he would take the arguments under advisement, and decide whether he will accept the plea agreement, possibly as soon as this week. (Lewiston Tribune)
