The defense team for the man accused of killing four University of Idaho students has asked the judge overseeing the case to force prosecutors to produce the training records for three officers involved in the investigation as well as FBI records pertaining to cell phone records and information on the search for the suspect’s car.
According to the Lewiston Tribune, Anne Taylor, the Kootenai County public defender who is representing Bryan Kohberger, told District Judge John Judge her team wants the training records to better understand the police officers’ process and the decisions they made with evidence in the case.
Latah County Deputy Prosecutor Ashley Jennings said these records are not material to the case and that the officers likely would not be called by the state to testify in court.
Taylor reminded the court that not producing discovery can be a due process violation and the standard is higher now that the Latah County Prosecutor’s Office is seeking a death penalty sentence.
Judge John Judge said he will take the matter under advisement and issue a written decision at a later time.
Kohberger is accused of stabbing to death four University of Idaho students in November.
A trial date has been set for October 2.
