Kohberger Attorney Files Change of Venue Motion Due to “Extensive, Inflammatory Pretrial Publicity”

MOSCOW, ID – The attorney for the man accused of killing four University of Idaho students in November 2022 has filed a motion to move his forthcoming trial out of Latah County Second District Court. According to the Motion for Change of Venue Bryan C. Kohberger requests a jury pool from outside the county because of the “extensive, inflammatory pretrial publicity” the murders have received.

Kohberger claims that finding an impartial jury would be difficult because of the small size of the community, the salacious nature of the alleged crimes, and the severity of the charges he faces.

“Enlarging the jury pool will not do anything to overcome that pervasive prejudicial publicity because Latah County does not have a large enough population center to avoid the bias in the community. Further, the size of the community and the interconnectedness of its citizenry is problematic and will prevent a fair and impartial pool of potential jurors,” the motion says.

“Kohberger, by and through his counsel, requests an opportunity to be heard through evidentiary presentation and argument no sooner than the end of April 2024,” the document says.

Kohberger is charged with four counts of First-Degree Murder in the alleged stabbing deaths of Kaylee Goncalves, Xana Kernodle, Ethan Chapin, and Madison Mogen in the early morning hours of November 13, 2022.  Following an investigation, Kohberger was arrested in his home state of Pennsylvania in late December of 2022. He was extradited to Idaho and continues to be held at the Latah County Jail.
